Firehouse Subs sued Calli Bakers Firehouse Bar and Grill near North Myrtle Beach for fraud and patent infringement because the two restaurants share the firehouse name.
In August, a U.S. District Court ruled Firehouse Subs can't patent the name "firehouse."
Later in October, a judge ruled Firehouse Subs had to pay more than $250,000 in attorneys fees to Calli Bakers owner, Heath Scurfield.
The national chain is now appealing that court decision.
Scurfield said he plans to continue to fight the lawsuit. No new court date has been set.
