A three-judge panel is set to hear a federal lawsuit disputing the results of a special South Carolina Senate primary.

The hearing is being held Tuesday in Charleston.

Earlier this month, Paul Thurmond - a son of the late U.S. Sen. Strom Thurmond - won a primary runoff defeating Charleston Sen. Walter Hundley.

A South Carolina voter had sued after state Supreme Court ruled a candidate who had once been removed from the ballot could remain in the race to fill the Senate District 41 seat.

Thurmond was the last GOP candidate remaining as hundreds of candidates were removed from ballots statewide over paperwork requirements. He was eventually disqualified himself over the paperwork issue, and the state court said the GOP could hold another primary - which Thurmond won.
