Lawsuit seeks runoff in US House 7

(AP) -- A lawsuit has been filed in Horry County asking the court to order a run-off between the top two vote-getters in the Democratic race for South Carolina's new 7th congressional district.

Attorney Morgan Martin of Conway confirmed he filed the lawsuit Thursday morning.

The state Election Commission is set to decide Friday whether to call a runoff between Democrats Gloria Tinubu and Preston Brittain. At issue is whether to count the votes of state Rep. Ted Vick, who withdrew last month but remained on the ballot.

The commission's director said in a letter Thursday to the state Democratic Party it's a longstanding policy to not count the votes of withdrawn candidates.

But the attorney general's opinion is that a court would rule that Vick's votes must count toward determining majority.
