Corey Wilson is being prosecuted by the South Carolina Attorney General's Office, according to officials with the Fourth Circuit Solicitor Office, on a charge of sexual battery.
Officials say they turned over prosecution to the Attorney General's office to avoid the appearance of impropriety because some people in the solictor's office know Wilson.
Wilson was a recruiter with the South Carolina National Guard, working at Latta High School, when he was arrested by state police last May for sexual battery against a student.
Officers say Wilson had sexual relations with the 16-year-old last May.
Deputies with the Dillon County Sheriff's Office they initially got involved in the investigation after Latta school district administrators made them aware of the allegations.
They turned the investigation over to the State Law Enforcement Division.
Wilson was placed on administrative leave with the SC National Guard following his arrest.
We're waiting to hear from the Attorney General's Office to learn if a trial date has been set.
