The aunt and guardian ad litem of the 10-year-old special needs student who was hit by two Darlington County teacher's aides has sued the school district.
The guardian ad litem is a term used to describe the person that will stand for the boy in court.
The aunt filed the lawsuit Tuesday claiming the district failed to train district employees who interact with special needs students and failed to recognize the boy didn't have the capacity to protect himself from assaults.
School bus surveillance video caught Tomeka Self and Rosanna Dudley slapping the boy on a school bus parked at St. John's Elementary school in April.
They pleaded guilty and were given a $268 fine.
