CHARLESTON, S.C. (AP) - A lawsuit is seeking to remove the son of late U.S. Strom Thurmond from a South Carolina state Senate race.

The Post and Courier reports a hearing is scheduled for Monday, the day before primary elections.

The lawsuit says Paul Thurmond should be disqualified from the GOP race because he didn't submit financial forms at the same time as candidacy paperwork.

The suit was filed by the husband of Carol Tempel, a Democrat who left a state House race after acknowledging she hadn't abided by a Supreme Court ruling requiring the filings be simultaneous.

Thurmond said he expected the challenge but is exempt from the requirement.

Three other Republicans have already been decertified from the race to succeed Glenn McConnell, who resigned the seat to become lieutenant governor.
