There was a mistrial declared Thursday for an Ash, North Carolina man charged in a killing that happened in 2009 in Little River, according to the 15th Circuit Solicitor's Office in Horry County.

Horry County police charged Thomas Edward Shipplett, 57, for the shooting death of Dale McDuffy Hammond, 56, in July 2009.

Police said Shipplett shot Hammond several times at his vacation home on River Road.

Eleven jurors voted guilty on a charge of Voluntary Manslaughter. One voted for guilty on a murder charge.

Solicitor Gregg Hembree says they will retry the case sooner rather than later.
