A lawsuit filed by Marlboro County against the South Carolina Department of Health and Environmental Control five years ago, finally heads to court Tuesday.
In 2007, Marlboro County sued DHEC after the agency issued a permit for MRR Southern LLC to build a dump near the Wallace community on a 900 acre piece of land between Highway 38 and 177.
DHEC moved to have the lawsuit dismissed, but that request was denied.
Judge Michael Nettles will hear from both sides at the Marlboro County Courthouse.
The mega dump issue has been a controversial one.
In 2008, the county held non-binding referendum and nearly 94% of voters opposed the landfill.
The Marlboro County Planning Commission voted against rezoning land in the northern part of the county for the mega dump, in 2009.
MRR then filed a a request with the zoning appeals board for a special use permit regarding the land, which would override the planning commission's vote.
The appeal was denied.
Later that year, MRR sued Marlboro County saying council unfairly denied a request to rezone property for the mega dump.
The company also sued a local citizens group for slander and defamation in 2010.
The company alleged in their lawsuit " Citizens for Marlboro County" initiated a smear campaign to damage the company's reputation.
