A Myrtle Beach man has filed a motion for a temporary injunction against the owner of a Myrtle Beach based website.
Scott Pyle accuses David Hucks, the owner of Myrtle-Beach.Com, of improperly using the website to post articles that relate to a split in Myrtle Beach Community Church, also known as Beach Church.
In November 2010, the pastor of Beach Church, Dan Grider, lost his job. He had been the senior pastor at Beach Church since 2006. Hucks and Pyle were both members of the church's leadership group. They were responsible for selecting leaders, elders and pastors at the church. After Paster Grider was fired, Hucks posted three blog entries on Myrtle-Beach.Com that, Pyle says, implies Pyle may have played a part in the firing of Pastor Grider based on his relationship with other members in the leadership group.
In a Conway courtroom Tuesday morning, Hucks' attorney said Myrtle-Beach.Com is a social city site used for news gathering, advertising, book and restaurant reviews, jobs and politics. Hucks' attorney argued the articles are subject to all First Amendment protections.
A Conway Magistrate will decide whether to grant the injuntion against Hucks and Myrtle-Beach.Com by the end of the week.
Hucks and Pyle have a history. Pyle filed a lawsuit against Hucks in 2010 over a bad business deal. In September, Hucks was arrested and charged with assault and intimidation harassment after police say he screamed at Pyle to drop that lawsuit against him or he was going to 'take him out'.
