Surfside Beach police charged Jonathan Phillips, 35, of Shallotte, North Carolina with Felony DUI and Possession of Marijuana.

Police say he ran the motorcycle he was driving into the back of a van on Melody Lane on August 11th. Both Phillips and his passenger sustained serious, life-threatening injuries. Police say the passenger was wearing a helmet, Phillips was not.

Police arrested Phillips Tuesday. They say his injuries resulted in a long hospital stay, which delayed his arrest. Phillips was released from jail on a $15,000 surety bond.
