Surfside Town council members and the public heard a report at their meeting Tuesday night about a recently filed lawsuit.

The lawsuit is from John Sifonios saying the town breached a contract regarding the pier restaurant space.

In April, town council chose John and Sonia Sifonios as the new operators of a pier restaurant. At a May meeting, a majority of town council voted to rescind the April vote.

Surfside Beach Mayor Allen Deaton says, " There will be future meetings with our attorney, probably in executive session, because they will actually have to try to remedy the lawsuit or respond, therefore we will have to set that up at a future date."

The town's lawyer told council - to his knowledge - the Sifonios had never signed a lease with the town of Surfside Beach.

The lawsuit also asks for an injunction, meaning the Sifonios could lease that restaurant space and seeks damages for potential lost profits.

Surfside Beach has until August 6th to respond to the lawsuit.
