A Marlboro County man who was molested by his band director filed a lawsuit against the school district and the former band director.
In 2007, Dwight Lawing was sentenced to ten years in prison for committing sexual acts against one of his students while Lawing was a music teacher at Wallace Elementary.
The victim, now 19-years-old, alleges in his lawsuit that the Marlboro County School District knew Lawing was a sexual predator and a threat to students.
Lawing's former student says it was common practice for Lawing to spend time alone with his students.
The lawsuit states that Lawing had a number of files containing child pornography on his personal computer and would use the computer for work-related-activities. It also alleges that several present and former teachers complained to Lawing's supervisor and principal concerning their suspicions and concerns over Lawing.
The victim is seeking judgement for actual, consequential and punitive damages for defendant's acts, and says the school district breached its duties to provide a safe learning environment for the victim in a reckless and grossly negligent manner.
The school district has 30 days to respond to the lawsuit.
