Vander Simmons, charged with murder in the death of his wife.
The Fourth Circuit Solicitor's Office says Vander Simmons of Bennettsville is scheduled to be tried next Tuesday.
Last April, state police charged Simmons with murder in the death of his wife, Brandy Simmons, 33.
In July 2009, doctors ruled Brandy died of an aneurysm. But her family wasn't convinced that was how she died and they wanted her body exhumed.
Police say Brandy's teenage daughter told them she saw her father, Vander Simmons, hit her mother with a stick several times at their Bennettsville home. The police report says the girl saw blood coming from her mother's mouth and said her stomach looked swollen.
A court order was granted to exhume Brandy's body nine months after her death.
An autopsy was performed. But police have yet to release the findings, only saying results are pending.
Simmons was arrested days later and charged with Brandy's murder.
Simmons has been of jail on bond since his arrest.
The South Carolina Attorney General's Office is prosecuting this case.
