SC AG: Judge right to let health care suit proceed

(AP) -- South Carolina's top prosecutor says a federal judge was correct to allow a lawsuit over the constitutionality of the Obama administration's health care overhaul to go to trial.

Attorney General Henry McMaster on Thursday praised the ruling issued by U.S. District Judge Roger Vinson.

McMaster and Florida Attorney General Bill McCollum rallied attorneys general in 18 other states in March to file a federal lawsuit challenging the sweeping health care reform legislation passed by Congress.

McMaster says the law is unconstitutional because it requires all Americans to buy health insurance and constitutes an unfair tax on citizens.

The Obama administration had asked Vinson to dismiss the entire lawsuit, which is likely to wind up before the U.S. Supreme Court.
