David Slough, the attorney for Freestyle Music Park, tells NewsChannel 15 FPI-MB Entertainment, the company that owns the park, will not make payment on the outstanding $570,000 debt by today's deadline.
Slough said the park has no ability to make the payment, but the park is working on it just as it is working on all of its payment obligations.
A bankruptcy court in Delaware set April 1 as the deadline for the debt to be paid. The debt is left from the park's days as Hard Rock Park. When FPI MB Entertainment purchased the park out of bankruptcy in 2009, it assumed that debt.
We have left a message with the trustee assigned to the case to see if a judgement will be issued by the court against Freestyle's owners.
Freestyle closed in September 2009 after a weak first season, but the owners had promised to reopen this year. Slough says it's unlikely the park will be able to reopen this summer.
