NewsChannel 15 has learned Fourth Circuit Solicitor, Will Rogers will not file charges against a Darlington City Police Officer, who was accused of using excessive force with a man he was trying to arrest.
In November, Darlington City Councilwoman, Gloria Hines and several others said they witnessed the officer shove the man's head against the patrol car.
Hines said she watched it happen outside her business on South Main Street. She said she could hear the impact from 200 feet away.
The officer was called to remove the man from a nearby store for disorderly conduct.
In a letter to the Darlington Police Department, Solicitor Rogers says after reviewing the dash cam video of the incident, he feels as if the officer acted within the law. Rogers says this case doesn't warrant prosecution.
The State Law Enforcement Division initially conducted the investigation at the request of city officials.
They turned their findings over to the Fourth Circuit Solicitor's Office.
