Prosecutors plan to retry the man police say left his child unattended in a strip club parking lot.

Wednesday, an Horry County judge declared a mistrial in the case against Geoffrey Hale. The jury was hung.

Myrtle Beach Police charged Hale with unlawful conduct toward a child in October of 2008.

They say he left his 10 month old daughter in a strip club parking lot for 12 minutes.

Prosecutors say such behavior is unacceptable and criminal and will re-try the case in the coming months.
