Former SC county councilman hopes to avoid prison

GREENVILLE, S.C. (AP) -- A former county councilman in South Carolina is asking a judge to allow him to remain out of prison while he appeals his conviction of illegally accessing the county administrator's computer.

The Greenville News reported that Tony Trout has filed court papers asking U.S. District Judge Henry Floyd to allow Trout to stay out of jail during the appeal. Floyd is to consider the request Tuesday.

Trout was convicted in July of illegally accessing computers belonging to County Administrator Joe Kernell and Yahoo and of intercepting and disclosing electronic communication. Trout was sentenced to one year and one day in prison.

Trout's filing Monday says his family needs him.

Prosecutors have said in court filings that Trout tried to obtain an assault rifle suppressor after his conviction.
