Councilman Marion Foxworth
NewsChannel 15 has learned that the city of Myrtle Beach is dropping all charges against Horry County Councilman Marion Foxworth.
Foxworth was charged with solicitation of and loitering for prostitution, stemming from an October 2007 prostitution bust.
The city sent out a news release around 5:20pm Thursday afternoon. The city's statement is below in its entirety.

STATEMENT FROM CITY OF MYRTLE BEACH REGARDING CHARGES AGAINST MARION FOXWORTH:
Because of prior media interest, this statement is made to inform the public of the status of its pending case against Marion Foxworth. In this case and all other criminal prosecutions, a prosecutor has the responsibility of a minister of justice and not simply that of an advocate. This responsibility carries with it specific obligations to engage in an analytical process to ensure that the defendant is accorded procedural justice and that guilt is decided upon the basis of sufficient evidence, beyond a reasonable doubt. Since the Defendant's arrest and throughout this process, the Defendant was treated with the same consideration as any other defendant.
The Office of the City Attorney has diligently used the time afforded by the continuances granted to both the City's and Defendant's attorneys to insure that proper documents were in place and to perform a detailed and careful review of all direct and circumstantial evidence, as well as all testimony to be provided by all the State's potential witnesses. That process is now complete. In consideration of the totality of the circumstances and facts of this particular case, the Office of the City Attorney has concluded it is in the interest of justice to dismiss all charging documents and not proceed with trial. No further public statement will be made.
