SC Supreme Court to hear primary case

(AP) -- The South Carolina Supreme Court has decided to take up a case challenging South Carolina's first-in-the-South presidential primary.

The court on Wednesday said the state and four counties suing it have to file papers by next Wednesday.

Beaufort, Chester, Greenville and Spartanburg counties filed a lawsuit Monday challenging the state Election Commission's authority to conduct the primary and force the counties to pick up part of the tab.

State Attorney General Alan Wilson filed an initial response to those claims on Wednesday and agreed that the state Supreme Court should take up the case. Wilson argues the state has the authority to run the primary because it was included in the South Carolina budget law passed this summer.
