Attorney for double murder suspect wants charges dismissed

The attorney for a Florence County man, charged with killing his estranged wife and her mother, wants the case against him dismissed. 

Attorney Rosemary Parham filed court documents with the Florence County Clerk of Court that she says spell out prosecutorial misconduct.

In motions filed by Parham, she says a conversation she had with the solicitor and her co-counsel was secretly recorded.

Her client, Hiralkumar Gopaldas, has been held without bond since June 28.

Deputies say he stabbed his estranged wife, Punam Gopaldas, and her mother, Vinaben Patel, at Punam's home at the Country Club of South Carolina in Florence County.

Court documents filed by Parham say last month she met with Solicitor Ed Clements and her co-counsel at the sheriff's office to see the physical evidence in this case.

Parham says a Florence County Sheriff's Office Evidence Custodian, who was also there, hit his left side with a box at one point, and they heard their conversation from a few moments earlier playing on a recording device.

Parham says the evidence custodian admitted he recorded the meeting on a hidden recorder in his pants and said he was told by someone at the sheriff's office to do it.

Parham wants the judge to dismiss the case against Gopaldas saying the sheriff's office conduct was inappropriate and unethical.

Circuit Court Judge Michael Nettles will hear the matter Wednesday afternoon at the Florence County Courthouse.

Gopaldas' father, Ranjit Kalabhai, is also charged in the murders.

He's been released from jail on bond.
