Retha Pierce was found guilty of resisting arrest in a December 25, 2007 arrest. She was sentenced to one year, which was suspended to 18 months probation.
She requested a jury trial on the charge, and a previous trial ended in a mistrial because of a hung jury.
Horry County police pulled over Pierce in the Little River area. She told the officer she had to use the bathroom.
Dash cam video shows Pierce refusing to get back in her car when the officer asked her to do so, and then she's placed under arrest.
Pierce has had three other run-ins with the law, although two of the cases were dropped, and one is outstanding.
On January 28, 2009, Pierce was arrested on trespassing and disorderly conduct charges from an incident at the Atlantic Beach Town Hall. When the case went to court, the arresting officers failed to show up so the judge dropped the charges.
Pierce was suspended in October 2009 by then-Governor Mark Sanford after she was indicted on a charge of leaving the scene of an accident with property damage in April 2009. Police say Pierce was pulling across three lanes of traffic, sideswiped a car, and then left. Pierce says the other car left.
A trial date has not been set on that charge.
Her DUI arrest came in September 2009. Pierce said she got sleepy on the way home from running an errand so she pulled off Highway 501 in Marion County to rest. She said an officer knocked on the window and told her she had been weaving on the road. Blood alcohol levels showed she was not under the influence so this case was also dropped.
