Questions & Answers
Question

What are the risks to using online legal services such as LegalZoom.com for your estate planning or choosing a business entity for your business?

Answer
One size doesn’t fit all.  This is not only true for your clothes, but for your legal affairs.  Cookie cutter forms can overlook important legal matters and cause more problems than you had initially.  The attorney knows what questions to ask to help you make proper decisions and identify issues requiring further thought or information.  In all important matters that affect you or your family, choose an experienced, competent attorney to guide and assist you.
Question

How do you deal with an adverse insurance representative?

Answer

There are numerous mistakes you could make in handling your own case.  One is the following: You do not owe the adverse insurance company a statement as to how the accident occurred or how much you think you are injured.  Although some insurance representatives act like you must give them your medical information, we do not recommend giving the adverse insurance company authority to collect your medical bills or reports.  What you tell an adverse insurance representative may diminish the amount they may be willing to offer in settlement or even ruin your case.

Question

Should tenants feel threatened by their landlord’s foreclosure?

Answer

Even though you have been paying your rent on time, if your landlord has failed to make the necessary mortgage payments, the lender can take steps to recover the money your landlord owes.  This may result in a foreclosure of the property.  Up until this year, if the landlord’s lender foreclosed on the property, the lender could legally evict you and any other tenants, regardless of whether you are up-to-date on your rent.  However, under the terms of the “Protecting Tenants at Foreclosure act of 2009,” the lender, or any immediate successor in interest to residential property in foreclosure, must give any existing tenant at least a 90 day notice to vacate the premises.

Question

Why do you need Title Insurance?

Answer

You probably have several forms of insurance already.  And, you undoubtedly are familiar with insurance coverage on cars, your life and medical bills.  But, Title Insurance?  When you buy a condominium, a home, any other type of building or even vacant land, you must have a complete investigation made on every aspect of the property.  Or, you may discover that the property you bought and paid for is not actually yours at all!  And even after the investigation, you will need protection in the event that some point has been missed in the public records or someone makes a claim on the title to your property.  That protection is a title insurance policy.

Question

What happens if you become disabled with no general power of attorney?

Answer

In such case, the spouse or children would have to go to the court and ask the Probate Court to appoint a Conservator and Guardian for you.  The Conservator manages your money and property and the Guardian is the one who determines what is best for you. You must have a hearing, post a bond and file annual accounting.  It is expensive and should be avoided if possible.

Question
What if I just need a simple will?
Answer
This is the most common question we hear from our clients.  Once a client realizes that it is in his or her best interest to have a new will executed, a client will often tell us, “All I need is a simple will.”  Generally, what that statement means is that the client feels that his or her estate is small enough that it will not be affected by state or federal estate taxes.  Determining whether or not there are any tax liabilities that you should be aware of is one of the responsibilities placed upon us as your attorneys.  However, even in those estates where there is no state or federal estate tax liability, we have found that our “will clients” generally require more than just the drafting of a death document.  For that reason, we offer a service which we refer to as Simple Estate Planning.
