SURFSIDE BEACH, S.C. (WPDE) - Early Sunday morning Randy Rizzo, 42, was pulled over by Surfside Beach Police. Rizzo is the former police chief of Atlantic Beach.

According to the police report, an officer pulled Rizzo over after watching him swerve several times while driving on highway 17.

After being pulled over Rizzo refused a field sobriety test and did not give a breath sample saying it "violated his civil rights," the reports says.

In the report, the officer describes Rizzo as having "glassy eyes, his speech was slurred, and his motor skills were slow" and says Rizzo also referred to the arrest as "blue on blue."

Rizzo is charged with DUI and received a ticket for no proof of insurance.

The report goes on to say during a property inventory of Rizzo's belongings an Atlantic Beach Police Deputy Chief badge was collected.

A court date for Rizzo is set for next month.
